Violations of Restraining Orders

Restraining order violations are criminal offenses not to be taken lightly. If you are thought to be intentionally violating the terms of a restraining order against you, you may be taken immediately into custody and to jail. If you are found guilty of violating the restraining order you may face a prison sentence of up to one year and/or a $1000 fine. If someone is injured during the violation, the fine will double and you will be subject to a mandatory 48-hour jail sentence as well as future misdemeanor or felony charges.

At The San Diego Law Office of James N. Dicks, defense attorney James Dicks and his staff are ready to assist you in defending your restraining order violation. We may be able to prove your innocence in the violation or otherwise defend your case to get you a lessened sentence or the charges dropped altogether.

San Diego Restraining Orders

Restraining orders are formal court orders, signed by a judge, which help to protect a person from someone who has been accused of assaulting or otherwise abusing the victim. They are most frequently issued in domestic violence cases and are often issued temporarily while a trial is ongoing. Women are more likely to request a restraining order against a man, rather than a man against a woman.

Having attorney James Dicks to represent you in your restraining order violation, as well as in contesting or working to get an invalid or excessive restraining order dismissed early, is the logical route if you would like to have a chance of being successful.
