DUI, or driving under the influence, is a criminal offense that is committed frequently in California. Driving under the influence is commonly described as operating, or driving, a motor vehicle while intoxicated or otherwise impaired by alcohol or drugs. In California, the legal limit for blood alcohol concentration (BAC) is below .08%. If your BAC is .08% or above you may be charged with a DUI.

California is one of many states which observe “implied consent” in regards to blood, urine or breath testing to determine your blood alcohol level. This means that, in driving, you are immediately giving your consent to be tested if you are suspected of driving under the influence. If you refuse to take a test, your license may be suspended immediately, whether or not your BAC was actually above the legal limit.
